LONG ISLAND BOAT SHOW MOVES TO MARCH IN 2010 MARCH 4th –7th The NYMTA has announced that the 53rd Annual Long Island Boat Show will have new dates beginning in 2010. The show will open on Thursday March 4th and continue through Sunday March 7th. The Long Island Boat Show, a staple in the month of February on Long Island for years had reason to make the move. "Once the New York Boat Show moved from mid December to late January, we felt a change like this was necessary, and we are very excited about it" said Vincent Mazzone, Events Manager for the NYMTA. "We feel strongly that is important to maintain some separation between our show and New York. Fortunately for us that change puts us in March which is closer to the boating season and an ideal time to shop for your new boat and accessories. Spring will be weeks away and most boaters will already have their minds on the water". This change comes off the heels of a 2009 Long Island Boat Show that switched from a two-weekend format to one weekend with great results. Attendance reached 8,000 for the four-day event, equaling its previous 3-year average over two weekends. This year’s show will once again feature a one-weekend format, opening Thursday March 4th and continuing through Sunday March 7th. This applies to everyone (including folks on larger boats making use of dinghy's they may have, etc).
New York Amended Life Jacket Law - Life Jacket Wear Requirements
Beginning November 1, 2009, Section 40, Subdivision 1 of the Navigation Law shall be amended by adding new paragraph (e), which reads as follows:
No owner or operator of a pleasure vessel less than twenty-one feet, including rowboats, canoes, and kayaks shall permit its operation, between November first and May first, unless each person on board such vessel is wearing a securely fastened United States Coast Guard approved wearable personal flotation device of an appropriate size when such vessel is underway.
Failure to wear a lifejacket on such vessels will be considered a violation under Section 73-c if the Navigation Law and is punishable by a fine of not less than $100 nor more than $250, applicable to either the operator and/or the owner of the vessel.
On July 11th, 2009 Governor Paterson signed **This law which goes into effect on November 1st 2009**
This new law will raise awareness and has the potential to save lives. Cold water immersion and hypothermia are twin dangers faced by a boater when a boat swamps or capsizes in water temperatures less than 60 degrees F. During the late fall and early spring, waterways have less boat traffic and response by rescue and law enforcement may be slower than in summer months. *Required on all vessels under 21 feet: This means motorboats, sailboats, kayaks, canoes, rowboats, & paddleboats, etc. *Must wear a life jacket from November 1st to May 1st. *All owners or operators must insure that everyone on board is wearing a properly fastened, USCG approved wearable PFD of an appropriate size when the vessel in underway. As an FYI, at all other times of year, NY law requires the use of a lifejacket when underway for everyone under the age of 12 unless in a fully enclosed cabin and for everyone regardless of age who operates a PWC/Jetski or waterski's.

(2) an out-of-State resident, or a resident of a foreign country who will be in this State for less than 90 days may operate a power vessel on the waters of this State, without having completed a boat safety course approved by the Superintendent of State Police in the Department of Law and Public Safety if the person presents:
(iii) a boat safety certificate issued by the state or country in which the person resides
(5) A person holding a United States Coast Guard operator's license may operate a power vessel on the waters of this State without having completed a boat safety course.
This means that ALL persons who drive their boats into NJ waters MUST complete a boating safety course and that course should be from their home State (i.e. New York). Folks can register for a boating safety course at www.safeboatingamerica.com.

SBA FLOORPLAN UPDATEThe Marine Retailers Association of America sent a letter to the Small Business Administration last week regarding concerns over the agency's new floorplan financing program for boat dealers. MRAA asked the SBA to make the following changes to its guidelines: * Allow for application of the program in non-title and title states. * Eliminate the $500,000 threshold for minimum loan amount. * Increase the maximum loan amount to $4 million from $2 million. * Use SBA loan proceeds to refinance existing or new inventory at the existing lender or for the acquisition or refinance of inventory at a new lender. * Expand the definition of franchise-only dealers since that business model does not apply to recreational boating. * Allow banks to be considered experienced on a case-by-case basis. * Be less restrictive on the requirement that boat dealers have to provide monthly financial statements. "We are asking the SBA to amend its guidelines with these recommendations, which will go a long way to ensure success of the program for boat dealers. KOKOMO, IND. – The U.S. Small Business Administration will offer government guaranteed loans to finance inventory for eligible auto, recreational vehicle, boat and other dealerships under a new pilot program announced today by SBA Administrator Karen Mills. Dealer Floor Plan (DFP) financing will be available beginning July 1, according to Mills. She announced the new program during a visit to Kokomo, Ind., with Dr. Ed Montgomery, President Barack Obama's Director of Recovery for Auto Communities and Workers. "Countless small businesses, including dealerships, across the country are facing significant challenges as a result of the uncertainty in the auto industry," Mills said. "Floor plan financing can offer some dealerships the opportunity to get through these tough economic times by allowing them to keep their inventory and cash flow intact, as well as save the jobs these small businesses provide." Mills and Montgomery discussed the new DFP pilot program, as well as other resources offered by SBA and the federal government to help small businesses in communities impacted by the troubles facing the auto industry. "Small businesses are the engine of our economic growth," Dr. Montgomery said. "We are committed to finding ways the federal government can cut through red tape and get resources to these companies quickly during these tough economic times. From supporting nearly $4 billion in lending to small businesses across the country since February to the Dealer Floor Plan financing announced today, the SBA is making the resources provided in the Recovery Act accessible and working to provided needed credit. The President is committed to continuing to work with federal officials to identify resources like these that make a real difference in the lives of our auto communities and workers." Floor plan financing is a line of credit that allows dealers to borrow against their inventory, and then repay that debt as they sell their inventory or borrow against the line of credit again to add new inventory. Under the DFP pilot program, the SBA will provide loan guarantees for lines of credit through its 7(a) program. DFP loans will be made through SBA lenders only for titled inventory, including autos, RVs, manufactured homes, boats and motorcycles. The pilot program will begin July 1 and will be available through Sept. 30, 2010, at which time the SBA will make the determination of whether or not to extend the program. DFP loans will be available for a minimum of $500,000 up to the $2 million allowable under the 7(a) program. With a maximum repayment term of five years, the loans will come with a 75 percent government guarantee. Borrowers will also benefit from the temporary elimination of fees on 7(a) loans made possible by the America's Recovery and Reinvestment Act of 2009. During a roundtable discussion later in the afternoon with local small business owners Mills provided information on other SBA loan programs and benefits provided by the Recovery Act. Specifically, small business owners can take advantage of higher government guarantees on some 7(a) loans, as well as reduced fees on both 7(a) and 504 loans. The agency is also providing more tools to help small businesses compete for federal government contracts, along with technical assistance and counseling for business owners and entrepreneurs to help them deal with the economic challenges they face. "We are committed to being the real partner small businesses need at this critical time," Mills said. "Floor plan financing is just the latest tool in our toolbox to help small businesses in communities like Kokomo weather this recession and drive our nation's economic recovery." Estimated 70 Million AmericansExpected to Hit the Water This SummerIndustry Helping Non-Boaters Find Affordable Options, ‘Get Feet Wet’ in Boating
As Memorial Day approaches – one of the most popular boating weekends of the year – the recreational boating industry trade group, National Marine Manufacturers Association (NMMA), reports there were an estimated 70 million Americans who went boating in 2008, a five percent increase over 2007, despite the recession and higher gas prices. What’s more, Discover Boating the boating industry’s national awareness campaign, today reported the results from a summer boating habits survey conducted in May of 25,000 members of the nation’s largest boat owners group, BoatU.S. The survey reveals that when compared to the 2008 boating season, 52 percent of respondents do not expect to change the way they use their boat this summer and an additional 39 percent predict they will actually go boating more if gas prices continue to remain lower than 2008. With gas prices currently hovering around $2.50 per gallon, much lower than last year’s nearly $4 per gallon, the industry expects this summer to be one of the busiest with boaters taking to the water in record numbers to de-stress and look for ways to vacation closer to home. The survey also found that more than two-thirds, nearly 70 percent, of respondents said spending time on the water plays a significant role in bringing their families together. About Discover Boating MEMBERSHIP ADVISORYAmityville, NY 05/19/09 10:47 AM EPA to Deny Waiver for E15 in GasolineDear Industry Colleagues, As you may know, a pro-ethanol lobbying organization called Growth Energy and 54 ethanol manufacturers recently submitted a formal petition to EPA requesting a waiver under the Clean Air Act to increase ethanol blend levels in gasoline up to 15 percent (E15) by volume. As is required by law, EPA on April 21 published a Notice for Comment in the Federal Register, beginning a 30-day public comment period that closes on May 21, 2009. There is enormous political pressure on federal agencies to allow a high blend level despite well-known problems with mid-level ethanol gasoline.
We are asking all interested parties to submit comments to EPA arguing that the waiver petition be denied. Although NMMA has been working with EPA and DOE to initiate testing on marine engines and equipment and has formally submitted a test plan for our sector, there has been no testing to date by any federal agency on the impacts of mid-level ethanol blends on marine products. As you all know, marine engines are designed and certified to run on not more than E10, the current legal allowable blend limit. Increasing the limit will likely bring marine engines out of compliance with federal clear air laws, damage marine engines due to higher temperatures, pose safety risks to boaters and sportsmen and likely mean warranties will be voided.
We ask you to support a science-first approach and urge EPA to deny the ethanol industry's E15 waiver request unless and until independent and comprehensive scientific testing is completed on a full range of marine engines and other products. In the coming days we will be developing a template for comments to EPA, and we would encourage your organizations to send comments directly to EPA. In the meantime, we have set up a grassroots advocacy toolkit linked directly to EPA that you and your members can use to send in comments.

DEALER ALERT MRAA Asks Dealers to Contact White House To Support SBA Floor Plan Loans MRAA says President Barrack Obama is now considering extending loans usually reserved for small businesses to dealers, making it easier for them to borrow money to acquire new and used boats. The SBA had placed a moratorium on using federal funds for floor planning. During a two day period preceding the industry American Boating Congress in Washington, D.C, Phil Keeter, MRAA President, and Larry Innis, MRAA Washington Representative, met with key employees of the National Automobile Dealers Association, the National Association of Development Companies, and the Small Business Administration. NMMA and the National Marine Bankers Association joined for the meeting with the SBA. Mr. Keeter had met earlier with the National Association of Guaranteed Government Loans, which administers the SBA 7 (a) loan program for floor plan financing. The purpose of the meetings was to discuss the need for federal assistance for boat dealer floor planning. The meeting with the SBA occurred immediately after a special meeting the SBA had in the White House to present the SBA plan for expansion of the 7 (a) loan program to floor planning at boat, car, and RV dealerships. The White House Office of Management and Budget is now considering the SBA proposal. Time is now critical. It’s easy. Yesterday, April 7, Governor Paterson signed Chapter 59 of the NYS Budget officially making apprentices legal again. Apprentices still are required to be trained as they were in the past. Please see the attached page so that you can comply with the law. Apprentices also have to be at least 17 years of age and are not allowed to apply restricted use pesticides. Contact your paint rep or check the DEC website to make sure all your paints are classified as general use. Please make sure you document the training of your apprentices and keep that info with your recordkeeping. If you have any questions, please call the office. Section 325.10 Eligibility and training for pesticide apprentices.(a) Each individual engaged in the commercial application of pesticides who is not a certified applicator or technician is considered a pesticide apprentice. An apprentice must be at least 17 years of age. An apprentice is required to receive 40 hours of pesticide use experience under the supervision of a certified applicator and receive a minimum of 8 hours of instruction on the requirements in section 325.18 of this Part, before such apprentice can apply general use pesticides under the off-site direct supervision of a certified applicator. It is the responsibility of the certified pesticide applicator or registered business to determine and so state that an apprentice is competent to perform applications. (b) For specific applications that are infrequent and narrow in scope, and where there is little risk associated with the application, a certified commercial pesticide applicator may request, and the department may approve on a case-by-case basis, amended training requirements for such special circumstances. (c) Documentation that a certified commercial pesticide applicator observed and instructed the apprentice as required in subdivision 325.10(a) of this Part must be maintained by the certified commercial pesticide applicator or registered business for three years. Such documentation must be made available to the department upon request. Documentation must include the following: (1) name and address of apprentice; (2) date(s) of instruction or observation; (3) content of training and certification category; (4) instructor's name and certification identification number; and (5) an evaluation concluding that the apprentice is competent to perform pesticide applications. (d) A copy of the documentation required in paragraph 325.10(c) of this Part must be made available to the apprentice if requested. GREAT NEWS!!!!!! Reports from Capitol Group in Albany are: NO LUXURY TAX! I am very pleased to inform you that the Luxury Tax on vessels has been taken out of the NYS budget!!! We will NOT have a luxury tax!!! Apprentices will be back We have also come to an agreement on the apprentice issue. The Governors office has agreed for us to use apprentices as long as the apprentices are 17 years old (old age was 16) and they are NOT allowed to apply restricted use pesticides. Currently there are 11 restricted use pesticides and none of them have been used by marinas in NY. Half of them are not being renewed. We expect apprentices to be allowed as soon as the Governor and legislature approves the budget - possibly by the end of this week. I will get more info to the membership by the end of the week on apprentices and will schedule apprentice training ASAP for those who need it/cant do it on their own. As for the negatives in the budget - all fees are being raised! Everything from DMV fees, permits, etc are being raised. This includes car and boat registrations, DMV fees and pesticide fees. We will forward that information as soon as it is received. In the past 10 years, I am very proud to announce that we have not had 1 negative bill pass against the marine industry/boating and have had 4 pro-active boating bills passed in NY. They are the sales tax equalization, real property tax, vessel dealer agreement and the antifoulant paint bill. Thanks to all that wrote letters and made phone calls.
